Terms & Conditions
1. The Contract
Anyone wishing to register for a hike must pay a deposit in person at the Quetzaltrekkers office. All such persons will be bound by the following conditions, and will hereafter be referred to as “the client”.
2. Payment / acceptance of booking
Registration will be accepted upon receipt of a deposit of half the cost of the hike. This money is to be paid to Quetzaltrekkers by at least 6 pm on the day before the scheduled trip departure. The balance is to be paid upon return of the hike.
3. Insurance
Prior to participation in a Quetzaltrekkers tour, the client is required to obtain a comprehensive travel insurance policy that includes health coverage, personal accident and liability, air ambulance and repatriation expenses in case of emergency. When obtaining travel insurance the client must ensure that the agent is aware of the type of travel to be undertaken. In the event that a client has not obtained a valid insurance policy prior to the start of the designated tour, the client agrees by the signing of the medical and terms & conditions agreement form to accept any and all responsibility for loss and financial costs of any and all emergency services provided.
4. Cancellation of a tour by the client
If a client cancels a tour before 6 pm on the day before the scheduled trip departure, the client will receive a full refund. If a client cancels a tour for any reason after this time, the deposit of half of the trip cost is completely non-refundable. We will discount at least US$10 for the payment for food, water and preparation time.
5. Cancellation of a tour by Quetzaltrekkers
Quetzaltrekkers reserves the right to cancel a tour for any reason, but will not cancel after 6 pm on the day prior to a designated departure, except for unusual or unforeseen circumstances out of our control. If a tour is cancelled by Quetzaltrekkers prior to departure, all deposits and trip fees will be refunded. If a tour is cancelled after departure for circumstances beyond our control, trip fees will be returned minus money to cover the costs of trip departure and actual trip costs incurred.
6. Unused services
There will be no refund for missed or unused services. If the client does not show up for a trip or arrives after the trip has departed, no refunds will be given.
7. Prices and surcharges
Quetzaltrekkers reserves the right to impose surcharges or price increases up to two weeks before departure.
8. Flexibility
The client appreciates, acknowledges and accepts that the nature of this type of travel requires considerable flexibility and allows for alternatives. The outline itinerary as given for each trip is taken only as an indication as to what each group may accomplish and not as a contractual obligation on the part of Quetzaltrekkers. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to local circumstances or events. These may include sickness, mechanical breakdown, strikes, events emanating from political disputes, entry or border difficulties, unfavorable climatic, seismic or volcanic conditions and/or other unpredictable or unforeseen circumstances including but not limited to those mentioned here.
9. Acceptance of risk
The client acknowledges and accepts that Quetzaltrekkers tours include activities that are adventurous in nature and that such activities inherently involve a certain amount of personal risk. The client hereby agrees to accept personally all risk associated with a Quetzaltrekkers trip.
10. Authority on the tours
At all times the decision of the Quetzaltrekkers tour leaders or representatives will be final on all matters affecting the safety or well being of the tour. The client must at all times strictly comply with the laws, customs, foreign exchange and drug regulations of all countries visited. Should the client fail to comply with the above or interfere with the well being of the group, the tour leader may order the client to leave the tour without any recourse to any refund.
11. Travel documents
The client must be in possession of a valid passport or a photocopy of same, including a copy of the entry stamp.
12. Information / advice given by Quetzaltrekkers
Any information or advice given by Quetzaltrekkers on visas, vaccinations, climate, clothing, baggage, special equipment, etc. is given in good faith but without the responsibility on the part of Quetzaltrekkers.
13. Factors outside of Quetzaltrekkers control
Quetzaltrekkers will do it’s best to minimize the effects of matters outside of its control which include but are not limited to political disputes, border closures, refusal of visas, industrial action, delayed flights, unforeseen climatic, seismic or volcanic conditions, acts of war and random acts of criminal violence.
14. Disclaimer
Many of the tours include activities which pose a certain element of personal risk. The client accepts and consents to the personal risks inherent in the implementation of the tour and accepts the limitations, terms and conditions of Quetzaltrekkers as being responsible. The client also agrees to not sue or hold liable the organization of Quetzaltrekkers, the guides, the employees, the staff or the volunteers of Quetzaltrekkers for any loss, injury, or death in conjunction or association with any Quetzaltrekkers trip or related event.
15. Use of equipment
QT provides hiking and camping equipment to the client if needed. Any items needed by the client are to be announced at least by the time of signing in to a trip. Quetzaltrekkers does not guarantee the availability of all needed items due to limited resources. The client agrees to treat the borrowed items with all necessary caution, to ask for advice on their use in case of doubts and to replace items that have been broken or are missing after the trip. If you are using gear equipment for Quetzaltrekkers Leon you will have to pay $10 deposit that it will be returned when you come back from the hike if all the equipment are in the same condition, if the equipment is damaged QT Leon will keep the deposit.
16. Privacy
Upon providing his contact details the client agrees with their anonymous use for internal statistical and economical evaluations for up to one year after trip departure. Upon providing his email address the client further consents to electronic updates on QT projects, hike schedules and newsletters. All medical information is considered confidential and will only be shared with the trip leaders and medical personnel. These data will be destroyed one month after trip departure.
